Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of our Terms of Service and applies to all users of Safe Merge ("the Service") operated by Third Space, LLC ("Thirdspace," "we"). Violation of this AUP may result in suspension or termination of your access to the Service.

1. Lawful Use

You must use the Service in compliance with all applicable laws and regulations, including data protection laws (GDPR, CCPA/CPRA), anti-spam laws, export controls, and sanctions. You must have lawful authorization to process any CRM data accessed through the Service.

2. Prohibited Activities

You may not use the Service to:

• Violate laws or regulations: Use the Service in any manner that violates applicable local, state, national, or international law.
• Process unauthorized data: Access or process CRM data for which you do not have lawful authorization from the data controller or data subjects.
• Reverse engineer: Attempt to reverse-engineer, decompile, disassemble, or extract source code from the Service, except where expressly permitted by applicable law.
• Overload or abuse: Use automated tools, scripts, or bots to stress-test, scrape, or overload the Service's API endpoints, or deliberately circumvent rate limits.
• Circumvent controls: Attempt to bypass billing controls, usage limits, authentication mechanisms, or security measures.
• Unauthorized access: Access or attempt to access accounts, systems, or data belonging to other users or portals.
• Share access: Share your Safe Merge access credentials or OAuth tokens with unauthorized third parties.
• Interfere with service: Engage in any activity that disrupts, degrades, or interferes with the Service or the experience of other users.
• Transmit malicious content: Upload or transmit malware, viruses, worms, or other harmful code through the Service.
• Misrepresent identity: Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
• Resell without authorization: Resell, sublicense, or redistribute access to the Service without Thirdspace's prior written consent.

3. Reconstruction Feature Usage

When using the Emergency Unmerge reconstruction feature, you additionally agree not to:

• Attempt to extract or reverse-engineer model weights, parameters, or training data through the Service
• Use reconstructions without conducting genuine human review
• Deliberately input manipulated or misleading data to influence reconstruction outputs
• Use reconstruction features for any purpose other than legitimate CRM record reconstruction

4. Duplicate Detection and Bulk Merge Rules

When using the duplicate detection and Bulk Merge Audit features, you agree to the following rules:

• No mass merge without review: You must review duplicate suggestions before approving merges. Blindly approving all suggested duplicates without genuine review is prohibited. Each merge action should represent a deliberate decision based on your evaluation of the match.
• No automated bulk merging: You may not use scripts, browser automation, or other tools to automatically approve and execute bulk merges without human review of each suggestion.
• Verify before merging: You are responsible for verifying that suggested duplicates are genuine duplicates before merging. False-positive matches may result in data loss or corruption that cannot be fully reversed.
• Respect confidence scores: Low-confidence duplicate suggestions require additional scrutiny. Merging low-confidence matches without additional verification is done at your sole risk.
• Bulk merge limits: Bulk merge operations are subject to your plan's record limits and HubSpot API rate limits. Attempting to circumvent these limits through any means is prohibited.
• Production data awareness: Bulk merges operate on your live production CRM data. While Safe Merge creates snapshots before merges to enable unmerge, you should maintain independent backups before performing large-scale bulk merge operations.

5. Data Handling

You are responsible for:

• Ensuring you have the legal right to process all CRM data accessed through the Service
• Providing appropriate notices to data subjects whose data is processed
• Maintaining appropriate security measures for your HubSpot account credentials
• Promptly notifying us of any unauthorized use of your account

6. Resource Consumption

Your use of the Service must remain within the limits of your subscription plan. Excessive use that materially impacts other users or the Service's infrastructure may be subject to throttling or temporary suspension with notice.

7. Enforcement

We reserve the right to:

• Investigate suspected violations of this AUP
• Temporarily suspend access to the Service during investigation
• Permanently terminate access for confirmed violations
• Report illegal activities to appropriate law enforcement authorities

We will make reasonable efforts to notify you before taking enforcement action, except where immediate action is necessary to prevent harm to other users or the Service.

If you become aware of any violation of this AUP, please report it to joshua@thirdspaced.com.

9. Changes

We may update this AUP from time to time. Material changes will be communicated via email at least 30 days before taking effect. The current version is always available at this URL.
